Policy Alert: Upcoming Treasury Consultations

The Department of the Treasury is holding several tribal leader Consultations within the next few weeks regarding the CARES Act Coronavirus Relief Fund payments, the American Recovery Plan Act (ARP) Tribal Relief Fund formula, and on Treasury's Consultation process itself.
It is important for tribal leaders to weigh in on these consultations. They will inform how the Department proceeds in distributing billions of dollars to Indian Country and have the potential to strengthen the government-to-government relationship moving forward.

Thursday, March 18, 2021:
Purpose: These sessions are related specifically to the CARES Act Coronavirus Relief Fund payments to tribal governments and will focus on the pending case The Shawnee Tribe v. Yellen, Case No. 20-cv-1999 (D.D.C.). These consultations will NOT cover the $20 billion fund for tribal governments established in the American Rescue Plan Act.

Wednesday, March 31, 2021, and Thursday, April 1, 2021:
Purpose: This set of consultations will focus on the distribution of the $20 billion of Coronavirus State and Fiscal Recovery Funds to tribal governments under the recently passed American Rescue Plan Act of 2021. Treasury is looking for input specifically on the formula the department should use to determine each tribe's share of funds and allowable expenditures for funds distributed to tribes. Consultation on other parts of the ARP will be scheduled in the future.

Purpose: The Department of the Treasury, Veterans Affairs, the Social Security Administration, and the Small Business Administration are hosting a tribal leader consultation on each agency's consultation policies. They are seeking feedback on how they can improve their policies and practices to better engage with Indian Country through meaningful consultation.
