DESCRIPTION:Join NAFOA for a webinar examining the finalization of Treasury rules on the General Welfare Exclusion Act and Tribal Wholly-Owned Corporate Entities—groundbreaking regulations that promise to transform Tribal economic development and provide long-awaited tax certainty for Indian Country.  \n\n\n\nAnnounced on December 15\, 2025\, these rules are the result of years of sustained Tribal advocacy and consultation with the Treasury Tribal Advisory Committee. They affirm Tribal sovereignty by granting Tribes deference in determining general welfare benefits. The rules explicitly exempt wholly-owned Tribally chartered corporations from federal income tax and recognize Tribal authority to make special needs determinations on par with states.  \n\n\n\nSpeakers will break down the key provisions of each regulation and explore their practical implications for Tribal finance operations and economic development strategies. SUMMARY:No “Magic Words” Needed - What Tribes Need to Know about Bankruptcy in Light of the Supreme Court Decision in Lac du Flambeau v. Coughlin
DESCRIPTION:Last month\, the Supreme Court ruled 8-1 in Lac du Flambeau Band of Lake Superior Chippewa Indians v. Coughlin\, holding that Native American tribes are not immune from certain bankruptcy court proceedings\, including the automatic stay provision of the Bankruptcy Code.  \n\n\n\n \n\n\n\nThe case involved an online payday lending operation owned by a tribal government.  When a customer sought relief in bankruptcy court\, an appellate court and the U.S. Supreme Court rejected the tribe’s claims that sovereign immunity prohibited the customer from enforcing the Bankruptcy Code’s automatic stay against it.On July 27th from 1pm to 2:30pm Eastern Time\, NAFOA is proud to host a webinar. DESCRIPTION:On Tuesday\, January 10\, 2023\, from 2:00 pm – 3:00 pm EST\, NAFOA is hosting a webinar with the Department of Energy’s Grid Deployment Office to discuss new opportunities as part of the Grid Resilience Formula Grants available specifically for tribes.  As part of the Bipartisan Infrastructure Law passed last year\, the Department of Energy has launched a new program that enables federally recognized Tribes to apply for electric grid resilience formula grants. \n			\n						Registration to Join on January 10th\n					 \nAs outlined in Sec. 40101(d) of the Infrastructure Investment and Jobs Act\, this program will have approximately $84M per year in formula grants available to Tribes for the next 5 years. Applications for Year 1 (FY22) and Year 2 (FY23) funding are due March 31st\, 2023.Grid resilience projects can be implemented on or off tribal trust lands as long as they provide benefit to the tribal community with the grant funding a wide array of resilience measures\, including: \n\nweatherization technologies\,\nequipment hardening or undergrounding\,\nvegetation management\, and\nenergy storage.\n\nDuring this information session\, representatives of the Department of Energy’s Grid Deployment Office will present a detailed overview of the opportunities and limitations of the Grid Resilience Formula Grant program\, provide guidance and strategies for submitting an application\, and answer questions from the audience.Topics will include project eligibility\, cost match requirements\, and how to approach constructing a program narrative for the application. The National Energy Technology Laboratory (NETL) team that will be administering the grant program will also provide an overview of the process for program execution once applications have been approved.

Moreover\, the impact of the pandemic has emphasized the value of diversifying tribal economies. \nFSA Advisors will discuss strategies to borrow in this interest rate environment and Federal credit policy and the Department of Energy’s Loan Programs Office (LPO) will outline how to apply for a direct loan based upon a new Solicitation. LPO has announced important changes to the Program to finance Tribe’s investments in energy. These include key changes to the debt capital program\, aimed at increasing tribal energy development to unlock the energy potential of Indian Country. This includes the ability to offer loans through the Federal Financing Bank directly to tribes. NAFOA welcomes staff from the Department of Energy and LPO office to discuss these changes and how tribes can use them to their advantage. \nThis webinar will take place July 28th from 1:00pm to 2:00pm Eastern Time and will be recorded.
