DESCRIPTION:Join NAFOA for a webinar examining the finalization of Treasury rules on the General Welfare Exclusion Act and Tribal Wholly-Owned Corporate Entities—groundbreaking regulations that promise to transform Tribal economic development and provide long-awaited tax certainty for Indian Country.  \n\n\n\nAnnounced on December 15\, 2025\, these rules are the result of years of sustained Tribal advocacy and consultation with the Treasury Tribal Advisory Committee. They affirm Tribal sovereignty by granting Tribes deference in determining general welfare benefits. The rules explicitly exempt wholly-owned Tribally chartered corporations from federal income tax and recognize Tribal authority to make special needs determinations on par with states.  \n\n\n\nSpeakers will break down the key provisions of each regulation and explore their practical implications for Tribal finance operations and economic development strategies. We will address implementation considerations\, including IRS training requirements and audit suspensions. Explanation of this final guidance will assist Tribes with leveraging this tax clarity to strengthen their economies while maintaining sovereign authority when designing welfare programs or structuring business entities.

Participants will learn proven ways to respond to financial crises and have a chance to ask questions and learn from each other.  \n\n\n\nWorkshop 2: Tribal Funding Impact Reports – Preparing Your Messaging with Data In this one-hour Workshop\, Tribes will be given steps to produce a custom Funding Impact Report that can be used to advocate for the necessity of their Tribal federal funding. Participants will learn simple ways to use readily available data and financial information to create reports that effectively tell their stories.

DESCRIPTION:December 16\, 17\, and 18\, 2024\, 1:00 – 4:00 p.m. ET – The U.S. Department of the Treasury (Treasury) and the Internal Revenue Service (IRS) have issued a Notice of Proposed Rulemaking (NPRM) regarding the tax status of wholly owned Tribal entities. Additionally\, Treasury announced it will hold Tribal consultations on the proposed rule on December 16\, 17\, and 18\, 2024\, at 1 p.m. ET. \n\n\n\nThis proposed rule describes that Tribal entities chartered or organized by one or more Tribes have the tax status of their owning Tribes. This means that these Tribal entities will not be subject to income tax. Further\, the rule describes that these Tribal entities will be eligible for certain Inflation Reeducation Act tax credits through a payment mechanism known as elective pay.
