DESCRIPTION:December 16\, 17\, and 18\, 2024\, 1:00 – 4:00 p.m. ET – The U.S. Department of the Treasury (Treasury) and the Internal Revenue Service (IRS) have issued a Notice of Proposed Rulemaking (NPRM) regarding the tax status of wholly owned Tribal entities. Additionally\, Treasury announced it will hold Tribal consultations on the proposed rule on December 16\, 17\, and 18\, 2024\, at 1 p.m. ET. \n\n\n\nThis proposed rule describes that Tribal entities chartered or organized by one or more Tribes have the tax status of their owning Tribes. This means that these Tribal entities will not be subject to income tax. Further\, the rule describes that these Tribal entities will be eligible for certain Inflation Reeducation Act tax credits through a payment mechanism known as elective pay. DESCRIPTION:Last Thursday\, the Department of the Treasury (Treasury) published a new interim final rule (IFR) for the State and Local Fiscal Recovery Funds (SLFRF) program\, as well as sending out a Dear Tribal Leader letter requesting consultation on the newly released rule. \n\n\n\nThere will be a consultation session held on November 29th at 2 p.m. ET and two webinars hosted by the Department to provide clarification on the new rule on November 16th at 10 a.m. ET and 3 p.m. ET. In addition to the consultation session\, the Treasury is accepting comments until December 22nd. Submit written comments at tribal.consult@treasury.gov.

DESCRIPTION:Last month\, the Supreme Court ruled 8-1 in Lac du Flambeau Band of Lake Superior Chippewa Indians v. Coughlin\, holding that Native American tribes are not immune from certain bankruptcy court proceedings\, including the automatic stay provision of the Bankruptcy Code.  \n\n\n\n \n\n\n\nThe case involved an online payday lending operation owned by a tribal government.  When a customer sought relief in bankruptcy court\, an appellate court and the U.S. Supreme Court rejected the tribe’s claims that sovereign immunity prohibited the customer from enforcing the Bankruptcy Code’s automatic stay against it.On July 27th from 1pm to 2:30pm Eastern Time\, NAFOA is proud to host a webinar.
